Ashton Kutcher's self-proclaimed mistress, Brittney Jones, will be featured in a sex tape that porn producer Vivid Entertainment is distributing, and Kutcher is not happy about it. But it's not her appearance that has the actor all fired up.
The issue is actually with the promotion of the video. "Ashton's fans will undoubtedly enjoy seeing what the star himself may have experienced," Vivid says in a press release for the tape.
In a legal letter to Steven Hirsch of Vivid, which was obtained by TMZ, Kutcher's lawyers state that Vivid is infringing on the star's "marketable celebrity identity value." In other words, they are not about to have Ashton's name associated with any pornographic material.
Kutcher has no part in the video and is obviously attempting to distance himself as quickly as possible. If his name continues to be used in promotion of the film, team Kutcher has threatened severe legal action -- and California law is on his side. Actors have a right to control use of their image and name.
