Daniel Baldwin files for divorce from Joanne Smith
Daniel Baldwin filed for divorce from wife Joanne Smith on Wednesday, July 13, two weeks shy of their fourth wedding anniversary. The couple has two children together: Avis Ann, 3, and Finley Ray Martineau, 1.
"Due to recent events in our home and for the safety of my children and myself, I have made this decision, Baldwin tells TMZ. "I have had my share of problems with drugs and alcohol many years ago and know first hand how difficult a position she is in."
TMZ obtained a declaration written by Baldwin in which he claims Smith threatened to kill him with a knife in front of their children.
After watching a documentary on women who kill their husbands, Baldwin claims Smith told him, "Now I know how to do it, I understand why they did it. You have been warned." After hearing their mother say this, their two daughters asked Baldwin, "Is mommy going to kill us?"
In the declaration, Baldwin claims Smith has punched him in the head, pulled a knife on him, slapped him and hit him with a phone.
On Tuesday, July 12, Baldwin, 50, filed a temporary restraining order against Smith, a former model. The judge who issued the restraining order granted Baldwin temporary custody.
Baldwin and Smith married on July 28, 2007. Baldwin appeared in four episodes of "Celebrity Rehab with Dr. Drew."
