Halle Berry obtained an emergency restraining order against her daughter Nahla's father, Gabriel Aubry, after a Thanksgiving Day beat down between Aubry and Halle's fiancé, Olivier Martinez.
The problem with that order, according to TMZ, is it expires in just a few days. So Halle is sending her lawyers to court to argue for a permanent order against Aubry that would keep him away from Halle, Olivier and Nahla for "an indefinite period."
In the past, Team Halle hasn't had any luck getting the Los Angeles courts to see it their way when it comes to restraining orders. Halle's nanny was denied an order after she accused Aubry of pushing her while she carried Nahla in her arms.

The judge at the time called the evidence in the case "insufficient and speculative." Perhaps Aubry's arrest report from Thanksgiving Day will be a little more "sufficient" this time around.
