According to Life & Style, Houska claims that her ex, Adam Lind -- the father to her 4-year-old daughter, Aubree -- has violated the terms of his visitation rights agreement.

Lind was charged with a DUI and was involved in a violent, "fiery car crash," so the visitation agreement between the two parents is that Lind can't drive with Aubree ... and according to Houska, he isn't following the rules. The MTV reality star plans to take legal action against him.

"I am documenting everything to make my case," Houska says. "It's a strict rule that he can't drive with her. But Aubree will come home and say, 'Daddy was driving with me.' It makes me so mad. He doesn't deserve visitation with our daughter if he keeps breaking the rules!"
